Gondwana Pink Grafted Macadamia Tree Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Gondwana Macadamias website (the “Website”) and your purchase of potted plants and related products from us. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or make a purchase.

Gondwana Macadamias is operated by Malleehawk Pty Ltd T/A Gondwana Macadamias ABN 51 618 620 938. We specialize in high-quality macadamia products, including potted macadamia plants grown and sourced responsibly, under Threatened Species Licence NSWPW.

1. Ordering

• You must be over 18 years old to place an order.

• Our minimum order is one item (e.g., one potted plant).

• There is no maximum order limit, subject to stock availability.

• Stock levels on the Website are updated regularly but are not guaranteed. Plants are living items, and sizes may vary slightly. We will send the best available plants at the time of your order.

• If we cannot fulfill an item in your order, we will contact you to offer a substitute or issue a refund.

• Once your order is submitted and paid, it cannot be modified or have discounts applied retrospectively. Please ensure your order is complete before checkout.

• We cannot combine separate orders after placement.

• Provide accurate payment and delivery details. We are not responsible for delays or failures due to inaccurate information.

• We reserve the right to reject any order, in which case we will refund any payment made.

2. Pricing and Payment

• All prices are in Australian Dollars (AUD) and include GST.

• Payment options include PayPal, Visa, and Mastercard (credit or debit cards).

• Your order will not be processed until full payment is received.

• We do not store your card details; they are handled securely by third-party providers.

3. Product Descriptions

• We strive to provide accurate descriptions, images, and care instructions for our potted plants.

• Macadamia plants are living organisms, and natural variations in size, shape, and appearance may occur.

• Purchases of our plants support sustainable farming practices and contributes to ongoing research and conservation efforts for Australian Macadamias, with annual donations being to Wild Macadamia Conservancy.

4. Shipping and Delivery

• We deliver to Australian addresses only, via Australia Post or courier services, using the most efficient method based on your location.

• International orders are not accepted at this time.

• Delivery to PO Boxes is available.

• Shipping times: Allow 5-7 business days for processing and packing, plus 5-7 business days for delivery. Peak seasons or holidays may extend this to 10+ days.

• We typically do not ship on Fridays or before public holidays to minimize transit time for live plants.

• You will receive an email confirmation with a tracking number upon shipment.

• Shipping charges are included in purchase price. To collect from farm please note on order, and shipping will be reimbursed at time of collection.

• Sorry we are unable to supply plants to Western Australia (WA), Tasmania (TAS), or the Northern Territory (NT), due to bio security laws.

• We pack plants carefully in protective packaging to ensure they arrive in good condition, but transit conditions are beyond our control.

5. Quarantine and Biosecurity Restrictions

• Due to Australian biosecurity laws, certain plants cannot be shipped to specific states or territories.

• Restricted items will be noted on product pages. If your order includes restricted items for your location, we will contact you for alternatives or a refund.

6. Returns, Refunds, and Replacements

• If you cancel your order before shipment, a $15 administration fee applies, and the balance will be refunded within 10 business days.

• Once shipped, orders cannot be cancelled. • Inspect your order upon arrival. If plants arrive damaged, incorrect, or in poor condition due to shipping:

• Contact us within 48 hours of receipt via email or phone, providing your order number, photos, and details.

• We will issue a refund for the plant value or send replacements if available.

• We do not accept returns or refunds for:

• Change of mind or incorrect orders placed by you.

• Damage after delivery (e.g., due to improper care).

• Perishable live plants beyond the 48-hour window.

• Refunds exclude shipping costs unless the issue is our fault.

• All returns must comply with Australian Consumer Law.

7. Warranties and Guarantees

• We guarantee plants leave our facility healthy and in excellent condition.

• Live plants are guaranteed to arrive alive, subject to the 48-hour notification period.

• Beyond arrival, no further warranties apply, as plant health depends on your care, environment, and conditions.

• We comply with Australian Consumer Law remedies for major failures.

8. Limitation of Liability

• To the extent permitted by law, we are not liable for any indirect, consequential, or incidental losses (e.g., loss of plants due to weather, pests, or neglect).

• Our liability is limited to the purchase price of the affected product.

• We are not responsible for delays or damages caused by third-party carriers, force majeure events (e.g., natural disasters), or inaccurate delivery details provided by you.

9. Privacy

• We collect personal information to process orders, communicate about your purchase, and send promotional materials (with opt-out options).

• We do not sell or share your data with third parties except as required for order fulfillment (e.g., shipping providers).

10. Intellectual Property

• All content on the Website (images, text, logos) is owned by Gondwana Macadamias or licensed to us and protected by copyright laws.

• You may not reproduce or use it without permission. 11. Governing Law

• These Terms are governed by the laws of New South Wales, Australia.

• Any disputes will be resolved in Australian courts.

12. Changes to Terms
